\emph{Max Possible To Date} refers to the number of
problem parts that you \emph{could} have completed up to this
point in the course. This means any problem which was open for 
you to do in the past, whether you got it right or wrong, or
whether it is currently open or closed.

It may still be possible to exceed this if your instructor
has changed the open dates of some problems, or excused you from a 
problem in advance of the open date.
